The Website presents a general overview of the range of products and services offered by FOUR WINNS, the FOUR WINNS dealer network, as well as boat shows and other events.

ACCESS TO AND USE OF THE WEBSITE

Access to the Website is free for users.
Users of the Website are solely responsible for their use of the Site, their behaviour and their actions. Users must not use the Website for any unlawful or prohibited purpose, or to encourage any activity that is unlawful or infringes the rights of SPBI or third parties. Under no circumstances may SPBI be held liable in the event of legal action being taken against users as a result of their use of the Website or as a result of their failure to comply with these terms and conditions of use.

The use of certain services on the Website may require the creation of a personal account, with a login and password. Users bear full responsibility for maintaining the confidentiality of information relating to their account, in particular their password, and for all operations carried out under their account.

Access to services requiring the creation of a personal account is only possible for users who have obtained the activation of an account in a lawful manner by SPBI. Failure to do so would render the user guilty of the offence of fraudulent access to an automated data processing system, subject to the applicable penalties (Article 323-1 et seq. of the French Penal Code).

To create a personal account, users undertake to fill in all the information marked with an asterisk in the Website’s forms. Failing this, the account creation request will not be processed. An account activation link is sent to users by email so that they can finalise their registration.
Users with a personal account undertake to notify SPBI of any change in their situation by updating their account details.
Users may delete their account at any time. In such a case, all the information in the account will be deleted and certain services will no longer be accessible.

For the services of the Website giving rise to the application of general terms and conditions of sale (“GTCSˮ), the request for deletion of a user’s account can only be successful if the user is up to date with their payments to SPBI.

In the event of inactivity on the account for an uninterrupted period of two (2) years or in the event of non-compliance by a user with these General Conditions of Use (“GCU”) and/or, where applicable, the GTCS applicable to the services, SPBI reserves the right to block all or part of the user’s personal account or to delete it.

CONTENT OF THE WEBSITE

All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as all computer applications that may be used to operate the Website and, more generally, all elements reproduced or used on the Site are protected by the intellectual property laws in force.

They are the full and complete property of SPBI or its partners.

Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of SPBI, is strictly prohibited.

The fact that SPBI does not initiate proceedings as soon as it becomes aware of such unauthorised use does not constitute acceptance of the said use or a waiver of proceedings.

INFORMATION ON PRODUCTS AND SERVICES

The information published on the Website is of a purely general and informative nature and is provided for information purposes only. It does not imply any legal commitment or contractual agreement on the part of SPBI, which reserves the right to modify the characteristics at any time.

The prices of the boats shown on the Website are given for information only. These are maximum recommended prices, subject to change and established in accordance with French regulations. To obtain precise and up-to-date information, particularly on prices, availability, characteristics, contents and variants of the various boats featured on the Website, users are invited to contact the dealer member of the FOUR WINNS network of their choice. Members of the FOUR WINNS network set their own prices for the products and services they sell.
The information contained on the Website is written in French but is translated into other languages to make it easier for users to understand. French is the reference language for its preparation and interpretation. The translations are as faithful as possible to the original French version. In the event of any discrepancies or inconsistencies between a translated version and the French version, the French version shall prevail.

SPBI will use its best endeavours to ensure that the information available on the Website is accurate. SPBI does not guarantee the reliability, performance or completeness of the Website or its content in relation to the use that the users wish to make of it. SPBI also does not warrant that the Website or its content will be error-free or that any defects will be corrected.
